Left-Wing Extremism and Human Rights unfolds a mosaic of social issues, especially of the weaker and marginalized section, closely intertwined with internal security. Based on an empirical study of the Left-Wing Extremism (LWE) movement in Andhra Pradesh, once the citadel of LWE, it offers a deep analysis of the growth and consolidation of LWE in India. It also studies the profiles and roles of NGOs in promoting rights for which specific case studies have been undertaken. As LWE and counter-extremist operations have become the major sources of serious human-rights violations in the country, the pan-Indian scenario of the movement bringing out its genesis, organizational structure, etc., have been elaborately dealt with in this book.

This book reinforces our knowledge and understanding of the problems involved in balancing human rights protection and security concerns, considering how these human rights issues have been raised by the various international debates and policy issues which have been created by the continuing global war on terrorism. In the shadow of 9/11 the threat of terrorism is an ever increasing global preoccupation. Terrorism and Human Rights discusses the effects of the legal and social aspects of terrorism by examining the relation between security issues and human rights from the angle of international organizations, political bodies and different countries. Some of the examples covered and which are examined in light of their approach and reaction to terrorism include the European Union, the UN, Russia and the United States. Previously published as a special issue of Terrorism and Political Violence, this volume will be useful for all students of security, politics and terrorism studies, but also for policy makers, legislators, and law enforcers.

Winner, Excellence Award, Best Insights into Asian Societies, Asian Publishing Award 2014 How could a group as respectable as Tata get it so wrong with human rights and community engagement in Kalinga Nagar and Singur? What lessons has it learnt? Why did Vedanta Resources Plc insist on mining in the Niyamgiri Hills in the face of opposition from the tribal inhabitants of the region who fear desecration of their god and losing their land and home? How valid are the safety concerns of the residents of Kudankulam protesting against a nuclear power plant? What gives a global giant like Posco the ability to ride over local sentiments in acquiring land for their mammoth steel plant in Odisha? There is growing discontent over the manner in which governments and businesses in India treat communities and stakeholders. Presumption, arrogance, suspicion and deceit often hold sway over community engagement and holistic human resource development. Disaffection of project-affected communities over issues of land acquisition, resettlement and rehabilitation has emerged as a major threat to economic growth in India, besides adding to the cost of businesses on account of lost opportunities, delays and liability. Driven to the wall, the world of business is finally waking up to the idea of human rights, of true corporate social responsibility. This book offers a must-do checklist for human rights, and for responsible business planning and policy-making. Sudeep Chakravarti speaks to senior executives, policymakers, activists, lawyers and local communities across such conflict zones in India to present a ringside view of the present and future of business and human rights. He breathes fresh understanding into some of the biggest human rights flashpoints in recent years - Vedanta, Tata Steel, Posco, Kudankulam - as well as less visible ones, and numerous forgotten projects, places and people that continue to haunt the development story of twenty-first century India. Clear. Hold. Build. is a groundbreaking work that highlights avoidable battle lines and seeks to change the way government, businesses and communities talk with each other, treat each other and work with each other.

While the legal systems of the United Kingdom and Germany differ in essential respects, the current process of 'constitutionalisation' is well recognised on both sides of the Channel. 'Constitutionalisation' manifests itself in the evolution of a constitution and the influence of existing constitutional principles on the ordinary law. Human rights law provides one of the best examples of this process, and the aim of this book is to provide a comparative UK-German perspective on recent developments. First, it addresses human rights questions which arise in both jurisdictions in a similar way such as the tension between liberty and security, absolute rights such as human dignity and the prohibition of torture, and the question how conflicts between human rights are to be resolved and conceptualised. A second theme considers the impact of human rights on different areas of law, in particular administrative law, criminal law, labour law and private law generally. Finally, a third theme focuses on the intersection of national, supra- and international human rights law, in particular after the entry into force of the EU Charter on Fundamental Rights. The book thus reveals convergent and divergent answers to similar problems, examines differences in the impact of human rights on the legal systems under consideration, and traces parallel and distinct debates over and sensitivities about, human rights as well as sensitivities that arise in multi-layer situations in the UK and Germany.
